The case of the petitioners is that under compelling circumstances, they have furnished such an undertaking and whereupon, their original testimonials were returned to them. It is the admitted case of the petitioners that, thereafter, they have participated in the counselling for the trainee teacher in Primary Schools, where they had deposited their original testimonials. In the meantime, a number of writ petitions were filed before this Court wherein, several directions were issued, one of which dated 26th September 2014 in Writ Petition No. 6390 (S/S) of 2014 - Neha Singh Versus State of U.P., mandated the Principal Secretary, Basic Education, to issue direction to Principals, DIET and District Basic Education Officers of the State to permit the candidates to participate in the counselling for trainee teachers on the basis of attested testimonials. The case of the petitioners is that pursuant to the said directions, the Principal Secretary, Basic Education, U.P. had issued a Circular, entitling the candidates to appear in the counselling for trainee teachers on basis of attested testimonials. The petitioners, after having come to know of such general direction issued by this Court and the Circular issued in this regard by the Principal Secretary, Basic Education, U.P., has approached this Court by way of instant writ petition for a mandamus directing the respondents to consider their candidature for appointment as Assistant teachers in SBS on basis of counselling already held. Learned counsel appearing on behalf of respondent Nos. 2 & 4 submitted that the petitioners have already appeared in the counselling for appointment in SBS and have thereafter submitted their affidavit, giving up their claim. Now, they can not resile from the undertaking given by them. It is not disputed that under the general direction issued by this Court on 26th September 2014 in Writ Petition No. 6390 (S/S) of 2014, the Principal Secretary, Basic Education, U.P. has issued a Circular whereunder, the candidates are now being permitted to participate in the counselling for the post of trainee teachers on basis of certified testimonials. As such, interest of justice would be served in providing that the claim of the petitioners for appointment on the post of Assistant teachers (Maths and Science) in Senior Basic Schools, shall remain alive till further orders of this Court. Such of the petitioners as are willing to appear in the next round of counselling, shall be permitted to appear provisionally, on the basis of attested testimonials, without prejudice to their rights. The petitioners have appeared in the first, second and third round of counseling held for appointment to the post of Assistant Teachers in Junior Basic Schools run by Basic Shikha Parishad, against 72,825 vacancies advertised in the State of U.P. vide advertisement dated 30.11.2011. The petitioners are waiting for their appointment letters. However, it appears that on account of an interim order passed by the Apex Court in Civil Appeal No. 4347-4375 of 2015 (State of U.P. & Others Versus Shiv Kumar Pathak), fourth round of counseling was held from 9.1.2015 to 14.1.2015. The candidates who have been left out in the first, second and third round of counseling and have obtained 70% marks in general category and 65% marks in reserved category, were allowed to appear in the fourth round of counseling. Submission of the petitioners is that the candidates who have obtained higher marks than that of the petitioners had appeared in the fourth round of counseling. Technical Education State Council of Educational Research and Training, U.P., Lucknow with the Principals of various DIETs and the District Basic Education Officers of different districts, it was resolved on 6.1.2015 and 7.1.2015 that the candidates who had appeared in the first, second and third round of counseling and whose names appear in the select list on the basis of those counseling, will be issued appointment letter with effect from 19.1.2015. It was also resolved that the fourth round of counseling will be held against the vacant seats from amongst the candidates having requisite percentage i.e. (70%� general category and 65% reserved category). They will be allowed to participate in the fourth round of counseling in the districts where they had applied, irrespective of the fact as to whether they had appeared in the first, second and third round of counseling. It is further observed that those candidates who had appeared in first, second and third round of counseling in certain districts, will also be allowed to appear in the fourth round of counseling in districts in which they had applied but could not appear in the earlier� three counselings for one or other reason. The process will be started on the basis of the select list prepared after last and final round of counseling wherein it was held from 9.1.2015 to 14.1.2015 to issue appointment letters from 19.1.2015 onwards. The petitioners submit that they had appeared in the first, second and third round of counseling, however, pursuant to the fourth counseling, appointment letters are not being issued to them on the ground that they are having lesser marks than the candidates who had appeared in the fourth round of counseling, though the petitioners are having requisite 70% and 65% marks as per the directions of the Apex Court dated 17.12.2014 in Civil Appeal No. 4347/4375 of 2014. Sri A.K. Yadav, learned counsel appearing for respondent no. 4 submits that as per the instructions dated 3.2.2015, the appointment letter cannot be issued to the candidates who are having lesser marks than the candidates appeared in the fourth round of counseling, in view of the directions of the Apex Court wherein the candidates having 70% and 65% marks have been allowed to participate in the fourth round of counseling as they have been wrongly left out. Written instructions dated 3.2.2015 received by the Chief Standing Counsel, High Court, Allahabad supplied by Sri A.K. Yadav, learned Standing Counsel for respondent no. 4 are taken on record. A perusal of the communication dated 3.2.2015 indicates that respondent no. 2, the Director, State Council of Educational Research and Training, U.P., Lucknow is of the opinion that no rights have accrued to those candidates for appointment who had appeared in the first, second and third counseling as fourth round of counseling was held pursuant to the direction of the Apex Court. The said assertion of respondent no. 2 appears to be incorrect. In view of the position that the petitioners have appeared in the first, second and third counseling and possess 70% in general category and 65% in reserved category, the petitioners have a prima facie right to be appointed against the post of Assistant Teacher in the districts in which they have applied and appeared in counseling as per their merit. A case for grant of interim mandamus is made out by the learned counsel for the petitioner. Learned Standing counsel and Sri A.K. Yadav, learnel Counsel for respondent no. 4 pray for and are allowed three weeks time to file counter affidavit. One week, thereafter, for filing rejoinder affidavit. List this matter on 13.3.2015. In the meantime, appointment letter be issued to the petitioner by the respective DIETs after verification of their eligibility and after ascertaining the fact of appearance in the counseling as per their merit.. Similar controversy came up before Division Bench of this Court in Special Appeal Defective No. 130 of 2014 Harsh Kumar & another vs. State f U.P. and four others connected with another Special Appeal No. 131 of 2014 Devendra Narayan Pandey and 11 others. It was observed that qualifications which have been prescribed by the NCTE in notification dated 29.7.2011 include two years Diploma in Education (Special Education) i.e. D.Ed. Once the qualifications have been prescribed by the NCTE, these would necessarily be binding and it is not open for the State Government to exclude (from the zone of eligibility). Consequently, Diploma in Education(Special Education) was held to be a qualification which is recognized for appointment on the post of Assistant Teacher for teaching class 1 to 5. A mandamus be issued directing the State Government to permit the appellants therein and such other persons who claim to be holding such qualification which are within the purview of the notification issued by NCTE on 23.8.2010 as amended on 29.7.2011, to apply for the post of Assistant Teacher for teaching class 1 to 5 which was subject matter of advertisement in question. Learned counsel for the petitioner submits that Special Leave Petition filed in the Apex Court against judgment of this Court dated 5.2.2014 in Special Appeal Defective Nos. 130 of 2014 and 131 of 2014 was dismissed on 13.1.2015. Learned counsel for the parties have pointed out that Writ-A No. 37599 of 2009, Writ-A No. 39637 of 2009, Writ-A No. 48050 of 2009, Writ-A No. 36587 of 2009 and Writ-A No. 33943 of 2009 raise different issues and are to be decided separately from this batch of petitions. Accordingly, these five writ petition shall stand detached from this batch of petitions. This batch of writ petitions had come before this Court wherein, the petitioners sought the issuance of a writ commanding the respondents to permit them to join as Assistant Teachers in the Basic Primary Schools in the Special B.T.C., 2008. The petitioners were compelled to approach this Court primarily on account of conditions imposed in the advertisement. These conditions non suited candidates who had obtained the B.Ed. Degree prior to enforcement of the NCTE Act, 2003 and/or candidates who had obtained degrees from institutions whose applications for recognition were pending at the relevant time. The learned counsel for the parties have accordingly classified the matter before this Court as falling under the following two heads: (A) B.Ed. degree obtained from Universities and affiliated colleges thereof before the commencement of the National Council for Teacher Education Act, 1993, which have been granted recognition after the Act came into force; (B) B.Ed. degree obtained from Universities during the pendency of applications for recognition after which they have been recognized. During the course of the said disputes being raised for B.T.C., 2007, this Court had been petitioned by various candidates assailing their rejection on the aforementioned grounds. Ultimately a Full Bench of this Court by its judgment was pleased to quash the offending conditions imposed in the Advertisement for Special B.T.C. Training Course, 2007. The judgment rendered by the Full Bench of our Court was taken in appeal by the State and was affirmed by the Hon'ble Apex Court vide its judgment and order dated 29th October, 2010. It would be apposite here to extract the relevant paragraphs of the judgment rendered by the Apex Court:- "[15] The real question that falls for our consideration is whether only B.Ed. Candidates who have obtained this degree after grant of recognition by NCTE or those candidates who have obtained their degree when the application of the institution for recognition was pending or such of those candidates who have obtained B.Ed. Degree prior to commencement of the Act, on 1st July, 1995 are also eligible to join the BTC course. On an analysis of the material available on record and the submissions, the following are the various possible distinctions identified during the course of several levels of litigations concerning the issue: (I) Degrees obtained from recognised institutions which have initiated such courses after the commencement of NCTE Act; (II) Degrees obtained from institutions during the pendency of applications seeking recognition which ultimately did not receive the recognition; (III) Degrees obtained from institutions during the pendency of applications after which they have been recognized; (IV) Degrees obtained from Universities and affiliated colleges before the commencement of NCTE Act which have been granted recognition after the Act coming into force; and (V) Degrees obtained from Universities and affiliated colleges before the commencement of the Act which have not been granted recognition. [18] A fair reading and analysis of the scheme of the Act with respect to recognition of the institution imparting course or training in teacher education is an essential prelude to the core questions involved. On a plain reading of the provisions it is evident that on and from the date of enforcement of the Act, every institution offering or intending to offer the course or training in teacher education, was required to make application to the Regional Committee in such from and manner as may be determined by the regulations as provided in Section 14 of the Act. The proviso to Section 14(1) states that an institution offering a course or training in teacher education immediately before the appointed day, shall be entitled to continue such course or training for a period and until disposal of the application by the Regional Committee. What happens in case of existing institution makes application seeking recognition within the prescribed time but no decision is taken by the Council within the period of six months? Does it mean that the institution can impart training only for a period of six months and thereafter close the institution? Section 14(5) states that every institution, in respect of which recognition has been refused shall discontinue the course or training in teacher education from the end of the academic session next following the date of receipt of the order refusing recognition passed under clause (b) of sub-section (3). [21] Prior to the enactment of NCTE Act, the degrees such as B.Ed. Course for teacher education were being awarded by the Universities or by the recognized institutions by the University Grants Commission or by such bodies as authorized by the University Grants Commission as the case may be were of sub-standard in anture in comparison to those degrees granted by the recognized institutions after the NCTE Act came into force. Such a view may amount to undermining the importance of the university education and the role played by the Universities in promoting the educations and educational standards. Each of the Universities have their own systems and mechanism to grant affiliation to the institutions offering courses at the college/University level and grant of affiliation is never considered to be a matter of course. Universities always ensure maintenance of standards and degrees awarded only after successfully completing the prescribed syllabi and the examinations conducted by the Universities. The NCTE Act in no manner makes any distinction between the degrees granted by the Universities or authorized bodies recognized by the University Grants Commission prior to the enactment of the Act and the degrees granted by the recognized institutions after the Act has come into force. NCTE Act provides for the recognition of the institution offering course or training in teacher education and does not speak about recognition of the degrees granted by the institution prior to the Act coming into force. Thus, degrees granted by the institutions already in existence offering a course or training in teacher education shall be deemed to be at par with the degrees or certificates granted by the recognized institutions after the commencement of the Act provided those institutions in existence offering the course also received recognition under the Act. [22] In our considered view the State Government cannot make any distinction between the degrees obtained from the existing institutions prior to the Act coming into force but received recognition after the comencement of the Act and the degrees obtained from the recognized institutions after the Act coming into force. It is not shown how such a classification is based on an intelligible differentia and on a rational consideration and further how it bears a nexus to the purpose and object thereof. The impugned action of the State results in the classification or division of members of a homogeneous group and subjecting them to differentia treatment without any rhyme or reason." For the present B.T.C. Training Course, 2008 similar offending conditions stood incorporated in the Advertisement in question. It is this advertisement which has led to the present batch of writ petitions being preferred before this Court. The respondents are directed to consider and scrutinize the claim of all the petitioners in these writ petitions in terms of the directions and the law laid down by this Court and the Hon'ble Supreme Court of India referred to hereinabove.
