The petitioner is holding D.Ed. (Diploma in Education) and has applied for the post of Assistant Teacher in Junior Basic School (Class I to V) as against the advertisement issued for appointment against 15,000 post of Assistant Teachers. He� has submitted On-line Application Form on 26.12.2014. It is stated that D.Ed. (Diploma in Education) is approved qualification for consideration as a training qualification for appointment on the post of Assistant Teacher by the NCTE vide notification dated 23.8.2010 as amended on 29th July, 2011. Submission is that the claim of certain candidates who had qualification of D.Ed. (Special Education) and cleared TET i.e. Teacher Eligibility Test came up for consideration before this Court determine their eligibility for appointment to the post of Assistant Teachers in Primary Schools in Special Appeal (Defective) No. 130 of 2014 (Harsh Kumar and another versus State of U.P. and 4 others) and another Special Appeal No. 131 of 2014 (Devendra Narayan Pandey and 11 others versus State of U.P. and otrhers). Both the appeals were allowed vide judgment and order dated 5.2.2014. The judgment of Special Appeal Bench, has been affirmed by the Apex Court in Special Leave to Petition(civil) No. 12060-12061 of 2014 which was dismissed on 13.1.2015.
The observations made in the case of Harsh Kumar and another versus State of U.P. and 4 others in paragraph '14' are as under:-
"In the circumstances, the special appeals would have to be allowed and are, accordingly, allowed. The impugned judgment and order of the learned Single Judge dated 14 November 2013 is set aside. A mandamus would, accordingly, issue directing the State to permit the appellants and such other persons who claim to be holding the qualifications which are within the purview of the notification issued by the NCTE on 23 August 2010, as amended on 29 July 2011, to apply for the post of Assistant Teachers for Classes I to V which was the subject matter of the advertisement in question."
The petitioner submits that the petitioner is holding same qualification and claiming parity with the qualification prescribed for the post of Assistant Teacher in the notification issued by NCTE, which is D.Ed (Special Education).
The matter requires consideration.
Sri R.A. Akhatar,� learned counsel has put in appearance on behalf of respondent no. 5, Sri Mrigraj� Singh, learned counsel for respondent no. 4 and learned Standing Counsel appears for respondent nos. 1 to 3 and 6.
All the respondents may file counter affidavit within three weeks.
One week, thereafter, for filing rejoinder affidavit.
List after four weeks.
In the meantime, the petitioner shall be allowed to appear in the counseling to be held for appointment on the post of Assistant Teacher in Junior Basic School on the Form submitted by him on 26.12.2014 and his candidature would be considered.
However, the appointment of the petitioner, if any, against the post of Assistant Teacher in Junior Basic School will be subject to the outcome of the writ petition.�

The grievance raised by the petitioner in the present writ petition is with regard to two select lists prepared for 50% of the post in Art stream and 50% of the post in science stream as against the total vacancy of 72,825 of Assistant Teacher in Junior Basic School pursuant to the advertisement dated 30.11.2011 and amended advertisement on 20.12.2011.
The submission of the learned counsel for the petitioner is that there was no justification for preparation of separate merit lists of Art and Science category as all the candidates have taken one examination for appointment on the post of Assistant Teacher in Junior Basic School. There is no separate Stream for the students of Junior Basic Schools(Class VI to VIII).The qualification as per rules is Graduation Degree with two years B.T.C. course and other training certificate and passing of TET Examination conducted by the State of U.P. The first counseling against 72,825 vacancies of Assistant Teacher in Junior Basic School commenced in the month of August 2014 and fourth and last round of counseling concluded on 14.1.2015. Petitioner belongs to female O.B.C. category and has obtained 90 marks in Art stream . Petitioner has given option for Districts, namely, Sitapur and Lakhimpur where the merit of candidate of female OBC in science category is less that 90 marks.The petitioner could not get through on account of preparation of separate lists for two streams. In an earlier writ petition similar controversy has been entertained by this court and the petitioner therein was allowed to participate in the counseling.
Having heard learned counsel for the parties and the record, the fourth and final round of counseling for 72,825 vacancies of Assistant Teacher in Junior Basic School is over on 14.1.2015 . The appointment letters are being issued in different districts from 19.1.2015 onwards . As the selection process is already over on 14.1.2015, no relief can be granted to the petitioner.The present writ petition has been filed on 17.1.2015 i.e.after three days of when final round of counseling is over. Any interference at this stage would result in displacement of the candidates who have already been selected for the post.
In view thereof no interference is required. The writ petition is dismissed . However it is open for the petitioner to approach the competent authority i.e. Principal DIET of Sitapur and Lakhimpur. In case, any post of Assistant Teacher remain vacant, the Principals (DIET) of the concerned districts shall consider the application of the petitioner and take appropriate decision in accordance with law.

The petitioner submits that she has obtained 419 marks out of 700 marks in theory and 252 marks out of 300 marks in practical in B.Ed.Examination, 2009 which was conducted by Chaudhary Charan Singh University, Meerut. As per statement of marks obtained from the university, it appears that as per statute of the university, the petitioner was given one grace mark and her division has been indicated as first, though she has obtained 419 marks only. In the application form for appointment of Assistant teacher in Upper Primary level school� i.e. class 6 to 8 in the column provided for indicating marks of theory the petitioner has mentioned her marks as 419 without adding one grace marks, on account of which she has passed� in theory in First Division in B.Ed. Examination, 2009.
Submission is that,� in case, the� division of the petitioner� is� treated as "first",� she�� would attain� 65.5 quality point marks which is more than cut off merit i.e. 65.21 for� counseling� in� District Kanpur� Nagar. The counseling� was held on 7.1.2015, however, the petitioner was not permitted to�� participate� in the counseling for the reason� that she has� obtained lesser� quality point marks than 65.2� marks.� She has�� submitted � a detailed� representation to� respondent Nos. 2� and� 3�� mentioning therein� entire facts and with request to allow her to make� correction in the application form.� No response� has been received and hence this writ petition.�
Admittedly, the petitioner has obtained� 419 marks� out of� 700 marks� in theory� paper of� B.Ed. Examination, 2009. As per the university. Rules, she was given one grace mark and her division was described as� "first".� It� appears that there is no column in the application form� to� mention�� the division� of� candidate in theory and practical papers.�
The question as to whether� one grace mark awarded to the petitioner� to award her first division can be considered by the� Director of�� State� Council of� Education, Research and� Training, U.P. i.e. respondent no. 2.
However, at this� juncture, learned� Standing� Cousnel� informs that� counseling � as against 27,000 vacancies� of� Assistant� Teachers in upper� level primary� schools is over and the appointment letters�� are� being issued to the selected candidates.
As the matter requires adjudication on the� part of respondent no.2,� this Court is of the view that at the first instance, the claim of the petitioner be examined by respondent no.2.
The writ petition is, therefore, disposed of with the following directions:-
1) The petitioner shall make a comprehensive representation before respondent no. 2 alongwith certified copy of this order within� two weeks.
2) In the event of� such an application filed by the petitioner,� the respondent no. 2 shall take an appropriate� decision as to whether� the petitioner is entitled for addition of� one� grace mark and� first division awarded by the� university in "theory� paper" of� B.Ed. Examination, 2009.
3) In case, the petitioner is found� entitled for consideration/addition� of one� grace mark in theory paper� in the� B.Ed. Examination, 2009 and further, in case,� any� vacancy exists for the post of� Assistant� Teacher as against the advertised� 27,000 posts in upper level primary schools and� any fresh� counseling� is held, the petitioner's� candidature may be considered.
4)� A reasoned and speaking order shall be� passed in accordance with law by the respondent No.2 expeditiously, preferably within 15 days from the date of submission of� application by the petitioner.
5) The decision� taken shall be� communicated to the petitioner� immediately.

The petitioner has appeared in TET Examination-2011 in SC category. The contention is that during the course of the counseling, he has developed visual impairment of 75% and has got certificate of visual disability issued by the C.M.O., Unnao.
The prayer is to allow him to appear in the fourth round of the counseling scheduled from 2.1.2015 and consider his candidature in Scheduled Caste category with a special category of visual disability.
Learned counsel for respondents submits that counseling for the appointment on the post of Assistant Teacher in Junior Basic School (class 1 to 5) is over on 14.1.2015. The petitioner has obtained disability certificate on 26.6.2013 i.e. much before the first round of counseling held in the month of August, 2014. He has never claimed benefit of special category/visual impaired, till 26.11.2014, when for the first time he approached authorities for consideration of his claim in special category.
The petitioner has taken a calculated risk and when he could not qualify for the post of Assistant Teacher in the SC category, he submitted his claim for special category/visually impaired. The petitioner's claim for inclusion in the special category cannot be considered at this stage for the reason that the counseling is over. Any interference would result in unsettling the candidates who have already participated in counseling as per their merit. As the selection process has already been completed, no relief can be granted to the petitioner.
The writ petition is dismissed as such.

The contention of the petitioner is that she has appeared in the counseling held in District Deoria on 19.9.2014 as against 29,334 vacancies of Assistant Teacher in Junior High School in Mathematics subject with 65.61 quality point marks. Submission is that on the same date, the counseling was held in two districts namely District Deoria and District Mau. On account of the said fact, the petitioner could only appear in District Deoria and it was not possible for her to go to District Mau and participate in the counseling at Mau. In Mathematics subject the cut-off was 65.15 which is much below the quality point marks of the petitioner. It is further submitted that though 6th round counseling is over, however, a decision has been taken to hold fresh counseling on account of the vacancies existing on the post of Assistant Teacher.
As the petitioner has appeared in the counseling on 19.9.2014 in District Deoria, she apprehends that in future counseling,� she may not be allowed to participate despite having higher quality point marks than the cut-off.
Sri S.K. Gupta, learned counsel for respondent no. 4 and Sri A.K. Yadav, learned Standing Counsel for respondent no. 2 submit that the petitioner may approach respondent no. 2 who can take a decision to allow the petitioner to appear in the counseling after examining the matter.
In view thereof, this Court is of the opinion that in case, the petitioner's quality point marks are higher than the cut-off in the district for which she has applied, she shall not be stopped from appearing in the future counseling, if any, held against the existing vacancies.
However,� the appointment of the petitioner shall be subject to the result of the writ petition.
In the meantime, counter affidavit be filed by the respondents within two weeks'.
One week, thereafter for filing rejoinder affidavit.
Put up on 20.2.2015 as fresh.

Learned counsel for the petitioner states that the petitioner was appointed as Shiskha Mitra in Primary School Ram Nagar, Vikas Khand Gauri Bazar, District Deoria, in the year 2006� thereafter she was sent for training and after completion of training, the petitioner was also given certificate in her favour. Learned counsel for the petitioner further states that on 07.03.2007 the petitioner fell ill and she went on leave and when she reported back on 15.07.2007, she was not permitted to join and sign on the attendance register since then she has been continuously representing but her grievances has not been considered, therefore the present petition has been filed for seeking writ of mandamus directing the respondents to consider and decide the claim of the petitioner.
Learned counsel for the respondent no.3� contends that the engagement of the Shiksha Mitra is purely contractual in nature for a period of one year and the scheme of the Shiksha Mitra has already been abolished in view of the Full Bench decision of this Court reported in the matter of Km. Sandhya Singh Vs. State of U.P. and others reported in 2013 (3) UPLBEC 2377.
After hearing the learned counsel for the parties and after perusing the averments made in the present petition, this Court is of the opinion that learned counsel for the petitioner could not make any good ground for the interference of this Court in exercise of powers conferred under Article 226 of the Constitution of India.
Accordingly, the writ petition lacks merit and is dismissed.

Ms. Beena verma, petitioner is present in person. She submits that she would argue her case herself.
In view of the above, vakalatnama of the counsel for the petitioner is discharged.
Heard petitioner in person, learned Standing counsel for respondents no. 1 and 2 and Sri Sandeep Kumar Yadav, learned counsel appearing for respondent no. 3.
The grievance of the petitioner in this writ petition is that she had earlier applied for Assistant Teacher in Primary Schools and had submitted her original testimonials therein. She thereafter also applied for appointment as Assistant Teacher (Maths and Science) in Senior Basic Schools but was not allowed to participate in the counselling held on 7.1.2015 on the ground that she is not possessed of original testimonials.
The submission of the petitioner is that once the original testimonials were presented in the counselling for the Assistant Teacher in Primary Schools, she is not supposed to reproduce them in the counselling Senior Basic Schools.�
Learned Standing counsel accepts that the petitioner had duly furnished her original testimonials in the counselling for Assistant Teacher� for Primary Schools and in view of the Government Order on the subject she is not required to produce the original testimonials again in the counselling for the purposes of appointment as Assistant Teacher in Senior Basic Schools.
In view of the aforesaid facts and circumstances, the writ petition is disposed of with the direction to the respondents to permit the petitioner to participate in the second or subsequent counselling scheduled to be held hereinafter for appointment of Assistant Teachers, Senior Basic Schools on the basis of the attested testimonials without insisting for the originals which have already been submitted by the petitioner during counselling of Assistant Teacher (Primary Schools).
The writ petition is disposed of accordingly.

The petitioner belongs to General Male Science category in the selection for the post of Assistant Teacher in Primary School as against 72825 vacancies advertised in the year 2011. Submission is that the petitioner has secured 124 marks in T.E.T. Examination 2011 (Primary School). Accordingly, he has participated in the 3rd counseling, however, cut-off in the counseling was higher than the marks secured by the petitioner and hence he was excluded from consideration. The petitioner has appeared for 3rd counseling in District Jalaun and could not participate in the counselling held in other districts as per the norms fixed by the respondents..
Submission of learned Senior Counsel for the petitioner is that in view of the circular dated 5.1.2015, the candidates having higher marks than the petitioner have been allowed to participate in the 4th round of counseling who have not appeared in the previous counseling. This has resulted in an anomaly on account of which, the candidates having higher marks than the candidates who had appeared upto 3rd counseling, were selected. As the petitioner has already appeared in the 3rd counseling, he could not participate in the 4th round of counseling for other districts. Now the petitioner came to know that the candidates having lesser marks than the petitioner have been selected in another District namely Sitapur.
Submission is that the petitioner having higher marks than the last selected candidates, has right for consideration as against the vacancy existing as on date.
Only prayer of learned Senior Counsel for the petitioner is to direct the Director of Education (Basic), U.P., Allahabad, Camp Office, Lucknow to consider the claim of the petitioner for appointment on the post of Assistant Teacher as against 72825 vacancies, in case, vacancy exist as on date.
To this submission learned Standing Counsel could not raise any objection. He submits that the claim of the petitioner can be considered by the Director of Education (Basic), U.P., Allahabad, Camp Office, Lucknow.
Sri K.K. Chand, learned counsel has received notices on behalf of respondent nos. 4 & 6 and learned Standing Counsel for respondent nos. 1, 2, 3 & 5.
In view thereof, the writ petition is being disposed of with a direction to respondent no. 2 i.e. the Director of Education (Basic) U.P., Allahabad, Camp Office, Lucknow to consider the claim of the petitioner for appointment on the post of Assistant Teacher, as against the vacancy existing as on the date of consideration, after calling for the comments of the Principal, DIET.
It is made clear that the petitioner's candidature can only be considered for the district for which he has applied.
The entire exercise be completed expeditiously preferably within a period of three weeks from the date a certified copy of this order is produced before him.

इलाहाबाद (ब्यूरो)। उत्तर प्रदेश माध्यमिक शिक्षा सेवा चयन बोर्ड की ओर से 25 जनवरी को हुई टीजीटी परीक्षा के सात प्रश्नों के उत्तर पर हिंदी विशेषज्ञ एवं उत्तर प्रदेश माध्यमिक शिक्षक संघ के कार्यकारी अध्यक्ष कौशल किशोर त्रिपाठी ने आपत्ति जताई है। उनका कहना है कि चयन बोर्ड की ओर से जारी सात प्रश्नों के उत्तर गलत हैं। हिंदी के 125 प्रश्न हैं, प्रत्येक प्रश्न के लिए 3.4 अंक तय हैं। इस प्रकार कुल सात प्रश्नों का कुल 24 अंक बनता है।
विशेषज्ञ का कहना है कि सीरीज 'ए' के प्रश्न-4 में उपजाऊ का विलोम ऊसर दिया है, जबकि सही उत्तर अनउपजाऊ माना है, इसके समर्थन में विशेषज्ञ हरदेव बाहरी के हिंदी व्याकरण पुस्तक को आधार बनाते हैं। प्रश्न-15 में अमीर खुसरो किस नाम से जाने जाते थे, बोर्ड ने इसका उत्तर तोता-ए-हिंद दिया है, जबकि सही उत्तर तूतिए हिंदी माना है, इसके समर्थन में पुनीत राय की पुस्तक वस्तुनिष्ठ हिंदी को आधार माना है। प्रश्न-24 में समस्त पृथ्वी से संबंध रखने वाला का उत्तर बोर्ड ने सर्वज्ञ दिया है, जबकि विशेषज्ञ के अनुसार सही उत्तर सार्वभौमिक है।

देहरादून : सुप्रीम कोर्ट ने उत्तराखंड के सरकारी बेसिक स्कूलों में शिक्षकों की भर्ती पर रोक लगा दी है. बेसिक शिक्षकों के 2794 पदों पर मेरिट की बजाय वर्षवार फ़ॉर्मूले के आधार पर भर्ती करने के मामले में दायर याचिका पर सुप्रीम कोर्ट ने यह फैसला दिया है. इसके अलावा मेरिट पर भारती करने के बेसिक शिक्षा विभाग की नियमावली के प्रावधान के उल्लंघन पर राज्य सरकार से एक माह में जवाब दाखिल करने को कहा है. यह फैसला नई प्रस्तावित भर्तियों और वेटिंग पर लागू होगा. वहीँ जिन मामलों में नियुक्ति पत्र जारी हो चुके हैं उन पर यह फैसला लागू नहीं होगा. सुप्रीम कोर्ट के इस फैसले की पुष्टि शिक्षा विभाग के अधिवक्ता डीके गर्ग ने की है. इस फैसले से बेसिक शिक्षकों के करीब 1505 पदों पर भारती की तैयारी पेंच फंस गया है. जानकारी के मुताबिक बीएड, टीईटी मेरिट संघ ने इस मामले में सुप्रीम कोर्ट में याचिका दायर की. संघ के अध्यक्ष सुरेन्द्र सिंह चौहान ने बताया कि विभागीय नियमावली के तहत नियुक्ति प्रक्रिया मेरिट के आधार पर होनी चाहिए लेकिन विभाग ने मनमाने ढंग से नियुक्ति का फ़ॉर्मूला लागू कर दिया. यह मामला पहले हाईकोर्ट में गया था जहाँ शिक्षा विभाग केस जीत गया था फिर संघ की याचिका को सुप्रीम कोर्ट ने स्वीकार करते हुए नियुक्ति प्रक्रिया पर रोक लगाने को कहा है. शिक्षा विभाग के अधिवक्ता डीके गर्ग ने बताया कि सुप्रीम

सुप्रीम कोर्ट का आदेश नहीं मान रही सरकार

इलाहाबाद (ब्यूरो)। प्रदेश के प्राथमिक विद्यालयों में हुई शिक्षक भर्ती में सुप्रीम कोर्ट के मानक पूरे नहीं करने का टीईटी पास अभ्यर्थियों ने आरोप लगाया है। टीईटी पास अभ्यर्थियों का कहना है कि कोर्ट ने सामान्य में 105 और आरक्षित कोटे में 97 अंक पाने वाले अभ्यर्थियों को नौकरी देने को कहा था, इसके बाद भी इस मानक का पालन नहीं किया गया है। इन अभ्यर्थियों ने आजाद पार्क में बैठक करके ऐलान किया कि वह 10 फरवरी को लखनऊ में प्रदर्शन के बाद सुप्रीम कोर्ट में अवमानना याचिका दाखिल करेंगे।

शाहजहांपुर। जिले में प्रशिक्षु शिक्षक चयन की दूसरी सूची बुधवार की रात को जारी कर दी गई। चयन सूची में आए प्रशिक्षु शिक्षकों को शुक्रवार को जिला शिक्षा एवं प्रशिक्षण संस्थान (डायट) में नियुक्ति पत्रों का वितरण बीएसए राजेश कुमार वर्मा द्वारा कराया जाएगा।

जिले में 72,825 प्रशिक्षु शिक्षकों की भर्ती प्रक्रिया के तहत 2800 पदों पर सहायक अध्यापकों की भर्ती की जानी थी। इसके लिए जारी की गई पहली चयन सूची में 2485 प्रशिक्षु शिक्षकों को शामिल किया गया था। इसमें 1114 लोगों को नियुक्ति पत्र लेकर प्राइमरी स्कूलों में ज्वाइन किया था। दूसरी चयन सूची का इंतजार रहे अभ्यर्थियों ने बुधवार को दिन में कलक्ट्रेट में प्रदर्शन कर डीएम से चयन सूची जारी कराए जाने की मांग की थी।

इसके बाद बुधवार की देर रात को कट ऑफ जारी कर दिया गया।
