Anju Respondent :- District Basic Education Officer And 2 Ors. Counsel for Petitioner :- Indra Raj Singh,Adarsh Singh Counsel for Respondent :- C.S.C.,B.N. Yadav Hon'ble Mrs. Sunita Agarwal,J. The petitioner has applied for appointment against the 72825 vacancies for Assistant Teacher in Junior Basic Schools( Class I to V). As she has obtained 116 marks in TET Examination(Primary) she was selected for counseling in three districts, namely, Shamli, Saharanpur and Budaun. She has appeared in counseling on 26.9.2014 at District Institute of Education, Patni, Saharanpur and submitted all her original papers before the competent authority. However she has not received any communication,though the appointment letters are being issued to the selected candidates . The Petitioner apprehends that her candidature could have been cancelled on the ground that she possess two years Diploma in Education from Madhya Pradesh, Bhopal.The contention is that the petitioner has obtained two years Diploma in Education from Indira Gandhi College of Education, Deepadi, Bhopal, which is a duly recognized institution by NCTE. Learned counsel for the petitioner submits that the petitioner has acquired the qualification prescribed by the NCTE vide Notification dated 29th July 2011 as she is graduate and possess two years Diploma in Elementary Education from Bhopal. Reliance is placed on the� judgement of Harsh Kumar and another Vs. State of U.P. and others reported in 2014(2) ESC 1061(All), wherein it was held in paragraph-12 that the qualifications which have been prescribed by the NCTE in the Notification dated 29th July 2011 include Senior Secondary with at least 50 % marks together with two years Diploma in Education(Special Education). It was held in paragraphs 13 and 14 that:- "13. In this view of the matter, we are of the opinion that the learned Single Judge was in error in coming to the conclusion that since the recruitment was in pursuance of a special drive, the Government was justified in confining the eligibility qualifications only to those who held the BTC qualifications for the reason that such candidates could not be adjusted earlier for want of TET qualification. The passing of the TET was introduced as a mandatory requirement by the notification dated 23 August 2010 issued by the NCTE. Persons who did not fulfill the eligibility conditions prescribed in the notification dated 23 August 2010, as amended on 29 July 2011, were not qualified for consideration for appointment as primary school teachers. Hence, there was no occasion for the State to contend or for that matter the learned Single Judge to accept the submission that in order to adjust such BTC qualified candidates, the present advertisement had been issued. The learned Single Judge held that the appellants could not claim equivalence with those candidates who possess BTC qualification. This, in our view, begs the question because once the Diploma in Education (Special Education) is held to be a qualification which is recognised for appointment of Assistant Teachers for teaching Classes I to V, it would be impermissible for the State Government to exclude them from being considered for appointment. In a special drive or otherwise, it is not open to the State Government to exclude one class of teachers who fulfill the qualifications for eligibility prescribed by the NCTE. Any such action would be impermissible for the simple reason that the exclusive power to prescribe eligibility qualifications for such teachers is vested in the NCTE. Once the NCTE has spoken on the subject, as it has through its notification, those qualifications must govern the eligibility requirement. Jurisdiction and power of the NCTE to do so is now settled beyond any doubt, as noted by the Supreme Court. 14. In the circumstances, the special appeals would have to be allowed and are, accordingly, allowed. The impugned judgment and order of the learned Single Judge dated 14 November 2013 is set aside. A mandamus would, accordingly, issue directing the State to permit the appellants and such other persons who claim to be holding the qualifications which are within the purview of the notification issued by the NCTE on 23 August 2010, as amended on 29 July 2011, to apply for the post of Assistant Teachers for Classes I to V which was the subject matter of the advertisement in question. " The question in the case of Harsh Kumar(Supra) was with regard to the determination of DED(Special Education) as the eligibility qualification for appointment to the post of Assistant Teacher in primary school. Learned Standing counsel has not been able to dispute the submission of the learned counsel for the petitioner. It appears that the institution from which the petitioner has obtained two years of Diploma from Indira Gandhi College of Education, Deepadi, Bhopal is a recognized institute by the NCTE and the qualification possessed by the petitioner is provided in the Notification dated 29th July 2011. It is,therefore, directed that the petitioner shall approach the Principal� DIET, Patni, Saharanpur and Basic Education Officer, Saharanpur within three weeks from today alongwith certified copy of this order. In case,it is found that the� petitioner had duly participated in the counseling held on 26.9.2014 and had submitted her original documents before the Principal DIET, Patni, Saharanpur, and that the marks obtained by the petitioner are higher than the cut of marks of the last selected candidate, the appointment letter shall be issued to the petitioner within two weeks from the date of the application. List this matter in the last week of February, 2015.In the meantime all the respondents may file counter affidavit. Petitioners have appeared in the examination conducted by U.P. Secondary Education Services Selection Board, Allahabad for appointment on the post of Assistant Teacher in LT Grade for Mathematics pursuant to the Advertisement No. 1 of 2010. Sri Ashok Khare, learned Senior Counsel for the petitioners submits that the revised panel stated to have been issued pursuant to the order dated 27.3.2012 in Writ Petition No. 14110 of 2012 which was filed by certain unsuccessful candidates. Submission is that there is no adjudication so far as the key answers are concerned and expert opinion was obtained by the Board. The re-valuation has been done without adhering to the proper procedure that too much after the selection has been finalised and appointment letters were issued to the petitioners. The petitioners were not heard at any point of time nor any notice was issued to them. They were taken by surprise by the revised panel published on 16.12.2014. In Writ Petition No. 14110 of 2012, no counter affidavit has been filed by the respondent- Board bringing on record the manner in which the re-evaluation has been done. Now, on the basis of� judgment of this� Court in Writ-C No.41279 of 2014 (Isha� Tyagi vs.� State of U.P. and three others), the petitioner is claiming benefit of� son of "Descendant of freedom fighters" category� on the ground of certificate of freedom fighter in the name of� Ram Lakshan Shukla and the relation/heir certificate issued by the� Tehsildar, Koraon, District� Allahabad(Annexure 4 to the writ petition). The benefit of� Isha Tyagi(supra)� could have been given to the petitioner, in case, the� counseling is underway. As the counseling is over, no� benefit� can be� granted at this stage. The petitioner� has not been able to obtain necessary cut off marks under general category and has not participated in the counseling in the said category. | UPTET SARKARI NAUKRI News - 44 लोगों ने टीईटी के फर्जी प्रमाण पत्रों से पाई नौकरी Posted: 11 Feb 2015 12:34 AM PST UPTET SARKARI NAUKRI News - 44 लोगों ने टीईटी के फर्जी प्रमाण पत्रों से पाई नौकरी Copy paste news , check local paper शाहजहांपुर। टीईटी के फर्जी अंकपत्रों को लगाकर नियुक्ति पाने वाले अभ्यर्थियों पर शिकंजा कसा जाएगा। माध्यमिक शिक्षा परिषद की ओर से जारी की गई टीईटी 2011 के परिणाम की मूल सूची से टीईटी के प्रमाण पत्रों का मिलान शुरू कर दिया गया है। इसमें फर्जी मार्कशीट लगाकर नियुक्ति पाने वालों पर कार्रवाई करके उन्हें जेल भेजा जाएगा। 72,825 प्रशिक्षु शिक्षकों का चयन टीईटी की मेरिट के आधार पर किया गया है। इस वजह से तमाम लोग टीईटी के फर्जी प्रमाण पत्र लगाकर प्रशिक्षु शिक्षक बन बैठे हैं। इसमें कई अभ्यर्थी तो ऐसे हैं जो टीईटी की परीक्षा में फेल हो गए थे, लेकिन नियुक्ति पाने के लिए उन्होंने 115 से अधिक अंकों की फर्जी मार्कशीट बना रखी है। इस वजह से शुरू की दो चयन सूचियों में ही उनका चयन प्रशिक्षु शिक्षकों के रूप में हो चुका है। ऐसे लोगों की जांच करने के लिए बीएसए ने कुछ कर्मचारियों को लगा दिया है, जो वर्ष 2011 के टीईटी परिणाम से जमा प्रमाण पत्रों का मिलान कर रहे हैं। इसके बाद अन्य सभी शैक्षिक प्रमाण पत्रों को सत्यापन के लिए भेजा जाएगा। इसमें जिन लोगों के शैक्षिक प्रमाण पत्र फर्जी पाए जाएंगे, उन पर भी कार्रवाई की जाएगी। डीएम के न मिलने पर शिकायतकर्ता लौटे बैरंग टीईटी मार्कशीट में हेरफेर करके जिले में प्रशिक्षु शिक्षकों के रूप में नियुक्ति पाने की वजह से तमाम पात्र अभ्यर्थियों को मौका नहीं मिल पा रहा है। ऐसे ही कई अभ्यर्थियों ने मय सुबूत के डीएम से शिकायत करने के लिए गए, लेकिन मंगलवार को डीएम के न मिलने की वजह से उन लोगों को बैरंग लौटना पड़ा। इसमें यूपीटीईटी संघर्ष मोर्चा के जिलाध्यक्ष सतीश शर्मा समेत अन्य लोग भी शामिल रहे। कई अभ्यर्थियों का 'डेटा नॉट फाउंड' माध्यमिक शिक्षा बोर्ड की ओर से इंटरनेट पर जारी की गई सूची से कई अभ्यर्थियों का डेटा मैच नहीं कर रहा है। ऐसे लोगों को कंट्रोल नंबर डालकर सर्च करो तो 'डेटा नॉट फाउंड' लिखकर आ जाता है। चार प्रशिक्षु शिक्षकों को मिले नियुक्ति पत्र शाहजहांपुर। 72,825 प्रशिक्षु शिक्षकों की भर्ती प्रक्रिया के तहत मंगलवार को चार प्रशिक्षु शिक्षकों को नियुक्ति पत्र दिया गया। पहली चयन सूची में 1111 और दूसरी सूची में 692 अभ्यर्थियों को अब तक नियुक्ति पत्र जारी किए जा चुके है। कुल 1802 अभ्यर्थी नियुक्ति पत्र पाकर ज्वाइन करने के लिए विद्यालयों में पहुंच चुके हैं। ज्वाइन न करने पर नियुक्ति होगी निरस्त बीएसए राजेश कुमार वर्मा ने बताया कि जो प्रशिक्षु शिक्षक नियुक्ति पत्र पा चुके हैं, वे लोग संबंधित विद्यालयों में जाकर ज्वाइन कर लें। समयावधि में ज्वाइन न करने वालों का अभ्यर्थन निरस्त कर दिया जाएगा। बीएसए ने जमा मार्कशीट के मिलान के लिए कर्मचारी लगाए 'माध्यमिक शिक्षा बोर्ड ने टीईटी 2011 का रिजल्ट दिया है, उससे मिलान किया जा रहा है। प्रमाण पत्रों के सत्यापन के दौरान जिनके प्रपत्र फर्जी पाए जाएंगे। उनकी नियुक्ति को निरस्त करके जेल भेजा जाएगा। बोर्ड से मिले से रिजल्ट का प्रमाण पत्रों का जमा प्रमाण पत्र के आधार पर मिलान भी शुरू करवा दिया गया है।' - राजेश कुमार वर्मा, बीएसए UPTET / टीईटी / TET - Teacher EligibilityTest Updates / Teacher Recruitment /SARKARI NAUKRI NEWS UP-TET 2011, 72825 Teacher Recruitment,Teacher Eligibility Test (TET), 72825 teacher vacancy in up latest news join blog , UPTET , SARKARI NAUKRI NEWS, SARKARI NAUKRI Read more: http://naukri-recruitment-result.blogspot.com http://joinuptet.blogspot.com UPTET 72825 Latest Breaking News Appointment / Joining Letter | Join UPTET Uptet | Uptet news | 72825 Primary Teacher Recruitment Uptet Latest News | 72825 Teacher Recruitment Uptet Breaking News | 72825 Primary Teacher Recruitment Uptet Fastest News | Uptet Result 2014 | Only4uptet | 72825 Teacher Recruitment Uptet News Hindi | 72825 Teacher Recruitment Uptet Merit cutoff/counseling Rank District-wise Final List / 4th Counseling Supreme Court Order Teacher Recruitment / UPTET 72825 Appointment Letter on 19 January 2015 |
