Petitioners have appeared in the examination conducted by U.P. Secondary Education Services Selection Board, Allahabad for appointment on the post of Assistant Teacher in LT Grade for Mathematics pursuant to the Advertisement No. 1 of 2010. They were duly qualified and appointment letter were issued on various dates. They have joined their respective institutions in the month of March, April and May- June, 2014 and are continuing as such. All the petitioners have successfully completed their probation period and have been confirmed on the post of Assistant Teacher. A revised panel dated 16.12.2014 for the post of Assistant Teacher in LT Grade for Mathematics has been issued by the respondent-Board resulting into displacement of the petitioners and hence this writ petition.
Sri Ashok Khare, learned Senior Counsel for the petitioners submits that the revised panel stated to have been issued pursuant to the order dated 27.3.2012 in Writ Petition No. 14110 of 2012 which was filed by certain unsuccessful candidates.
Submission is that there is no adjudication so far as the key answers are concerned and expert opinion was obtained by the Board. The re-valuation has been done without adhering to the proper procedure that too much after the selection has been finalised and appointment letters were issued to the petitioners. The petitioners were not heard at any point of time nor any notice was issued to them. They were taken by surprise by the revised panel published on 16.12.2014.
In Writ Petition No. 14110 of 2012, no counter affidavit has been filed by the respondent- Board bringing on record the manner in which the re-evaluation has been done.
Sri Nikhil Kumar, learned counsel has put in appearance on behalf of respondent no. 2.
Connect and put up this matter as fresh alongwith Writ Petition No. 14110 of 2012 on 10.2.2015.
However, till 10.2.2015, the effect and operation of revised panel published on 16.12.2014 shall remain stayed.

This writ petition has been filed� by 22 petitioners.� In� paragraph 3 of the supplementary affidavit filed today, it is stated that petitioner Nos.1,2,4,5,10,11,12,13,14,15, 17,18,19, 20, 21 and 22 have participated in the counseling held in� the districts mentioned in the table given therein.
So far as� petitioner Nos. 3,6,7,8,9 and� 16 are concerned, they have� not participated in the counseling, hence no relief can be granted to them. However, for those petitioners who have participated� in the counseling, it is directed that� they may be� considered for appointment to the post of� Assistant� Teachers in Junior Basic� Schools run by� Basic Shiksha� Parishad.� However, their selection and appointment� would be subject to the outcome of the writ petition.

Petitioner is an applicant for 29,334� posts of Assistant Teacher(Science/Mathematics) in Senior Basic School run by the Basic Shiksha Parishad notified pursuant to the Government Order dated 11.7.2013.Petitioner is holder of L.T. qualification and claim that the said qualification is equivalent to B.ED as it has been recognized as training qualification to the post of Assistant Teacher in the state of U.P. at the relevant point of time. Petitioner has successfully cleared� U.P. T.E.T. Examination, 2011 for upper primary level and has secured 95 marks . He belongs to general category. The counseling is going to be held from second week of February, 2015.The apprehension is that in view of the decision of the State Level Committee dated 27.9.2011, he would not be allowed to participate in the counseling though he possessed qualification equivalent to B.Ed.which is a recognised eligibility qualification for the post of Assistant Teacher. In writ petition no. 57605 of 2014, the question as to whether L.T. is equivalent to B.Ed. has been entertained by this Court.
The matter requires consideration.
Learned standing counsel appears for the respondent nos. 1 to,3 and 5. Shri R.P. Shukla, learned counsel appears for respondent no.4.
All the respondents may file counter affidavit within four weeks.
Two weeks thereafter for filing rejoinder affidavit.
List after six weeks. Connect and list with writ petition No. 57605 of 2014 .
In the meantime, petitioner shall be allowed to participate in the counseling.� However, the appointment of the petitioner, if any shall be subject to the final out come of this writ petition.

Admittedly, the petitioner has not passed the U.P. TET Examination in primary level. Her husband died on 30.3.2011. The petitioner has applied under Dying-in-Harness Rules on the post of Assistant Teacher in Primary School (Class I to V) and she was not found eligible for appointment on the post of assistant teacher and her claim for compassionate appointment has been rejected by the respondents vide order dated 22.7.2013. She filed a Writ Petition No.� 14624 of 2014 which was decided on 10.3.2014 with a direction to respondents to consider the claim of the petitioner and take a decision.
Pursuant thereto, the claim of the petitioner was considered and rejected on 4.10.2014. Earlier order says that the petitioner was not having TET qualification for appointment to the post of Assistant Teacher (Class I to V).
Learned counsel for the petitioner, however, submits that the petitioner has passed U.P. TET Examination-2013 for Upper Primary Level which is a qualification for appointment to the post of Assistant Teacher in a Senior Basic School (Class VI to VIII), in the State of U.P.
So far as the contention of learned counsel for the petitioner that the petitioner is entitled for consideration for the post of Assistant Teacher in Upper Primary School (Class VI to VIII), learned counsel for the respondent nos. 3 & 5 prays for and are allowed ten days' time to seek written instructions.
Learned Standing Counsel may also seek instructions in the meantime.
Put up this matter on 27.2.2015 as fresh.

The submission of the petitioner is that she has lost the aforesaid mark-sheet issued by the Board of High School and Intermediate and that she has applied for the issuance of the duplicate mark-sheet. The entire result of U.P.T.E.T. of 2011 is available online. The respondents can verify her result online and� there appears to be no necessity to insist for the original mark-sheet.
Learned Standing Counsel may seek instructions if it is possible to verify the result of the petitioner as suggested and to give her appointment accordingly.

The petitioner has applied for the post of Assistant Teacher advertised on 30.11.2011 against 72825 vacancies� in� Junior� Basic Schools run by Basic� Shiksha� Parishad. Fourth and final round of counseling was over on 14.1.2015 and appointment letters are being issued� to the selected candidates� from 19.1.2015 onwards.� Admittedly, the petitioner has applied� under "General� category" against the vacancy advertised on 30.11.2011. Now, on the basis of� judgment of this� Court in Writ-C No.41279 of 2014 (Isha� Tyagi vs.� State of U.P. and three others), the petitioner is claiming benefit of� son of "Descendant of freedom fighters" category� on the ground of certificate of freedom fighter in the name of� Ram Lakshan Shukla and the relation/heir certificate issued by the� Tehsildar, Koraon, District� Allahabad(Annexure 4 to the writ petition).
The benefit of� Isha Tyagi(supra)� could have been given to the petitioner, in case, the� counseling is underway. As the counseling is over, no� benefit� can be� granted at this stage. The petitioner� has not been able to obtain necessary cut off marks under general category and has not participated in the counseling in the said category. The writ petition has no force after counseling is over.� The writ petition is accordingly dismissed.

 72825 प्राथमिक शिक्षकों की भर्ती में हाईकोर्ट का निर्देश
जागरण संवाददाता, इलाहाबाद : इलाहाबाद हाईकोर्ट ने प्रदेश के प्राथमिक स्कूलों में प्रथम, द्वितीय व तृतीय काउंसिलिंग में शामिल अभ्यर्थियों को सहायक अध्यापक पद पर नियुक्ति पत्र जारी करने का आदेश दिया है। 1यह आदेश न्यायमूर्ति सुनीता अग्रवाल ने राजीव कुमार सिंह व अन्य की याचिका पर दिया है। याचिका में तीनों काउंसिलिंग में सफल होने के बाद चतुर्थ कौंसिल की मेरिट से चयन से बाहर करने की वैधता को चुनौती दी गई है। याची का कहना है कि 72825 प्रशिक्षु शिक्षकों की भर्ती में याचीगण तीनों काउंसिलिंग में सफल है। सुप्रीम कोर्ट के 17 दिसम्बर 14 के आदेश से चौथी काउंसिलिंग की गई। इसकी मेरिट में याचीगण को बाहर कर दिया गया। इस पर कोर्ट ने प्रथम, द्वितीय व तृतीय काउंसिलिंग में सफल याचियों को नियुक्ति पत्र जारी करने को कहा है और सरकार से जवाब मांगा है।



सुप्रीम कोर्ट में उप्र सरकार के खिलाफ अवमानना1राज्य ब्यूरो, इलाहाबाद : प्राथमिक शिक्षकों की नियुक्ति में धांधली के आरोपों का सामना कर रही प्रदेश सरकार को अभ्यर्थियों ने सुप्रीम कोर्ट में भी घेरने की कोशिश शुरू कर दी है। इसके तहत अभ्यर्थियों ने उच्चतम न्यायालय में प्रदेश सरकार के खिलाफ अवमानना याचिका दाखिल की है। याचिका में आरोप लगाया गया है कि सरकार ने अदालत के फैसले की अनदेखी करते हुए नियुक्ति पत्र बांटे। मांग की गई है कि ऐसा करने वालों के खिलाफ विधिक कार्यवाही की जाए और नियुक्तियों की जांच सीबीआइ से कराई जाए। अभ्यर्थियों की ओर से आरटीई एक्टिविस्ट समिति के लीगल एडवाइजर आरके पांडेय ने बताया कि सुप्रीम कोर्ट ने 17 दिसंबर को अपने फैसले में सरकार को छह हफ्ते में सामान्य 70 प्रतिशत और आरक्षित वर्ग 65 प्रतिशत तक को सहायक अध्यापक पद पर नियुक्ति देने का निर्देश दिया था। इसके साथ ही धांधली में लिप्त अभ्यर्थियों को बाहर करने का आदेश भी दिया गया था। इसके बावजूद सरकार ने ऐसा नहीं किया। बल्कि धांधली व फर्जी लोगों को नियुक्ति दी गई। अभ्यर्थियों ने नियुक्तियों में धांधली से जुड़े साक्ष्य एकत्रित करने शुरू किए हैं। इसके लिए गत दिवस आजाद पार्क में एक बैठक करके आगे की रणनीति भी तय की गई।

प्रशिक्षु शिक्षक भर्ती को लेकर बैठक आज

लखनऊ (ब्यूरो)। प्रशिक्षु शिक्षक भर्ती को लेकर सचिव बेसिक शिक्षा एचएल गुप्ता की अध्यक्षता में बुधवार को बैठक होगी। राज्य शैक्षिक अनुसंधान एवं प्रशिक्षण परिषद (एससीईआरटी) के निदेशक सर्वेंद्र विक्रम सिंह ने डायट प्राचार्य और बेसिक शिक्षा अधिकारियों को बैठक में प्रशिक्षु शिक्षकों को दिए गए नियुक्ति पत्र और उनके जॉइनिंग के बारे में पूरा ब्यौरा लेकर आने को कहा है। बैठक में यह पता चलेगा कि प्रशिक्षु शिक्षक भर्ती में अब कितने पद खाली हैं। गौरतलब है कि प्राइमरी स्कूलों में 72,825 प्रशिक्षु शिक्षकों की भर्ती प्रक्रिया चल रही है।

इलाहाबाद। हाईकोर्ट ने परिषदीय विद्यालयों में 72825 प्रशिक्षु अध्यापकों की नियुक्ति के मामले में प्रदेश सरकार को निर्देश दिया है कि पहले, दूसरे और तीसरे चरण की काउंसलिंग करा चुके अभ्यर्थियों को नियुक्ति पत्र दिया जाए। हालांकि उनकी नियुक्ति याचिका के अंतिम परिणाम पर निर्भर करेेगी। कोर्ट ने प्रदेश सरकार और बेसिक शिक्षा परिषद से जवाब भी मांगा है। राजीव कुमार सिंह और अन्य द्वारा दाखिल याचिका पर सुनवाई कर रही न्यायमूर्ति सुनीता अग्रवाल ने यह आदेश दिया।
याचियों के वकील अनिल बिसेन और अग्निहोत्री कुमार के मुताबिक प्रशिक्षु अध्यापकों की भर्ती के लिए तीन चरण की काउंसलिंग कराई जा चुकी है। शेष बचे हुए पदों के लिए चौथे चरण की काउंसलिंग कराई गई। चूंकि चौथे चरण में अभ्यर्थियों की मेरिट काफी ऊपर चली गई इसलिए अनंतिम सूची में पहले, दूसरे और तीसरे चरण के कम मेरिट वाले अभ्यर्थियों का नाम सूची से बाहर कर दिया। अधिवक्ताओं की दलील थी कि शुरू के तीन चरणों की काउंसलिंग में चयन प्रक्रिया पूरी हो गई। चौथी काउंसलिंग बचे हुए पदों के लिए कराई गई इसलिए उनकी मेरिट के आधार पर पूर्व में चयनित अभ्यर्थियों को बाहर करना गलत है। सुनवाई के लिए कोर्ट ने अंतरिम आदेश में याचीगणों को नियुक्तिपत्र जारी करने का आदेश दिया है।
